The general terms and conditions of sale and use of the Danaefabienne Marketing de Cosmética S.L. Company described above and below establish the rights and obligations of the company in the context of the website danaefabienne.es. Accessing this website and conducting e-commerce herein implies the total acceptance of these terms and conditions of sale and use. Any person wishing to benefit from the services provided at this webpage and registered in the system shall hereinafter be referred to as “customer" or as "user”. By clicking on the “Buy” button during the ordering process, customers declare to fully and without reservations agree to these General Terms and Conditions of Sale which, in any case, may be saved and printed by customers in order to be reviewed when deemed necessary. Data filled by danaefabienne.es constitute proof of all transactions made between the company and its customers. In addition, Danaefabienne Marketing de Cosmética S.L. will provide confirmation to customers immediately but usually no longer than 24/96 hours after the order was placed. Likewise, once ordered products have been sent, Danaefabienne Marketing de Cosmética S.L. will notify customers within 24/96 hours that the shipment has been made.

 

 

Conclusion of the contract

 

The information relating to goods and prices is subject to confirmation and without commitment. By placing your order, you are submitting a binding offer based on the information on goods and prices effective at that point in time and based on the announced period of validity;  this offer is accepted if and when we confirm acceptance of the offer by means of our shipping confirmation.  Until that point in time, we shall be entitled, in particular, to refrain from supplying the goods offered in the event they should be unavailable.  A right of delivery of the good shall arise only upon acceptance of the offer. If the product is unavailable after the order has been placed and before the shipment in question has been made, customers will be notified by e-mail that a partial shipment will be made or that their order will be cancelled. If the customers’ account has already been charged, when information about the unavailability of the product is given, a process will begin to refund the corresponding amounts to customers and they will be notified by e-mail about such process. Danaefabienne Marketing de Cosmética S.L. reserves the right to reject any order from a customer in dispute or a reasonable doubt of delivery may exist. We will refund the amount paid by customer as soon as possible; in this regard the company will refund the corresponding amounts within a maximum period of thirty (30) days.

 

 

Payment

 

The payment for purchases may be made in several ways:
With a Credit/Debit Card through a SSL secured connection and Visa Verified of our bank Catalunya Caixa.
With your PayPal account.
By cash upon delivery of products which is only available in Spain, Germany, France and Austria.
By bank transfer which may be chosen for orders from several countries in the European Union.

 

 

Delivery

 

All our shipments are notified by e-mail. After expediting the order the system automatically creates an invoice online, indicating shipping costs and sales tax separately. In case an order is placed from somewhere other than within a European member state the Spanish sales tax (IVA) of 21% will not be charged; this might lead to the need of a manual acceptance. All orders placed are an offer of purchase and are subject to acceptance. Danaefabienne Marketing de Cosmética S.L. reserves the right to reject any order from a customer with whom there is a dispute or exists reasonable doubt of delivery as well as a product is no longer in stock which includes special offers and promotions.

Danaefabienne Marketing de Cosmética S.L. is not responsible for customs charges and restrictions that vary from country to country and result from the importation or certain products. The purchaser remains responsible for all charges and fees which may be placed. If the products are returned to sender or the recipient cannot proof a non-delivery past 60 days it is him who is held responsible for the 50% product value and the non-reduced actually paid shipping fees. In case the package is returned to us because the customer cannot be reached or does not receive the package after a notice has been left, it is him who will be held responsible for the non-reduced actually paid shipping fees and a 10% quote of the total bill. The residual value will be returned.

In order to optimize delivery, we appreciate if customers indicate an address where the order can be delivered during normal working hours. A delivery is considered made once the carrier hands the product over to the customer or a notice of attempt to delivery has been left to the customer; this action is materialized through the control system used by the carrier. If the delivered products do not match the ordered indicated on the delivery order, customers must submit their claims within seven (7) days after delivery and we, of course, will replace the product; nonetheless the received product shall not have been opened.

 

 

Delivery time

 

Our cosmetic products are shipped in Spain with MRW and the Spanish Post and the delivery time can be estimated with 3-4 working days (Correos) and 24/48h working days (MRW).

Delivery time to Germany, Austria and Switzerland usually takes approximately 5-10 working days when the Spanish post (Correos) has been chosen as carrier.

Orders within the European Union may take 6-10 working days to delivery; additionally 6-15 working days may be added for delivery to other countries. If the customer orders the shipment via courier the usual period for delivery is 48-96h (Germany) 72-144h (EU) from the moment the package leaves Spain.

Packages are usually sent within 24/48h working days upon order or in case of bank wire upon availability date.

 

Delivery times are average times for preparing orders and shipping and are calculated based on the estimated time given to us from the Spanish post service and MRW as well as our own experience. These times also vary according to the destination and do not include bank holidays or weekends or any delay forced caused by weather, strike or logistic delay. Our cosmetic products are sent in perfect condition, carefully parceled and insured within its package. In the very unusual event that the package is damaged to the degree that the cosmetics may be harmed the customer must open a claim at the moment of reception and maintain the package as received in order to maintain the possibility of replacement. If this unlikely event occurs please contact us by mail or phone immediately. Recipients should verify shipments upon arrival, expressing their observations and presenting a claim if the package is likely to have been opened or shows clear signs of deterioration. It is at the time of receipt when customers must communicate these circumstances, if applicable, and therefore open a claim to the authority of delivery.

 

 

Cancellation rights

 

If the product is not the ordered one we will exchange it without any cost and problem.

When you have purchased the goods or services as a consumer (i.e. for private use as opposed to business use), please note that you are entitled to cancel any contract completed with us within 15 days from the day on which you acquire physical possession of the goods.

Returns
In order to ensure our customers receive the best level of service we offer a comprehensive returns policy.
Please note that the following returns procedure must be followed, and failure to do so may result in us being unable to exchange goods or provide refunds. Also please be aware that we cannot be held responsible and provide refunds/exchanges products which have already been used or their seal has been broken.

Should you wish to return an item for any reason please notify us within 15 days of receipt of your order. In order to arrange a return, please contact us and inform our customer service team of your order number, the item you are returning and the reason for the return through our contact us form or via Email.
We will then reply with a unique returns authorization number and the address you need to send the item to. You'll need to package the item securely and include:
- Your order number
- Whether a replacement or refund is needed
- The reason why you are returning the item.

Goods returned should be in their original condition, unused and the seal should not be broken.

Once received items will be checked and refunds on goods where suitable and refund may take between 15-21 days. We cannot issue refunds on simply unwanted goods due the perishable nature of goods on sale. Refunds/exchanges will only be offered on items that are faulty, and were clearly so at the time at which they were dispatched. We will bear the costs of shipment in case of wrongfully delivered products different to the ordered ones. In all other cases it is the buyer who is in charge of the return-shipment.

Danaefabienne of Spain backs up its products sold by danaefabienne.es online store. If for any reason the customer is not completely satisfied with any Danaefabienne product, the price will be reimbursed in full, including shipping costs once the product has been returned to the Company with the corresponding proof of purchase. The consumer and user can process the guarantee by contacting Danaefabienne by email to info@danaefabienne.com and returning the product within 30 days from receipt of the product to the address:

Once you have received the product at the address above, we will return the shipping costs of the return.

NOTE: Danaefabienne will not be responsible for transportation costs incurred in case of failure to follow the return instructions. Remember it is imperative to contact before returning.

 

Prices

 

The prices of our products and are shown with the Spanish sales taxes included and exclude shipping and handling costs until the registration process has been finished. Shipping and handling costs are shown with taxes included. Transport costs are stated separately. The Spanish sales tax (IVA) is applicable to orders placed by residents all member states of the EU. All other orders for destinations outside the EU are IVA exempt, and the sales tax element of the order will be taken off at the checkout; this will equate to an 21% discount from the order total.

Unless a product is on offer, part of a promotion, or offered as a free gift, all prices shown reflect the selling price. Danaefabienne Marketing de Cosmética S.L. reserves the right to change these prices at any time; nonetheless, products will be billed based on the current prices when the order is made; provided the products are in stock.

 

 

Special offers

 

Danaefabienne Marketing de Cosmética S.L. reserves the right to withdraw any special offers at any time. The customer must meet the requirements for eligibility to purchase in order to take advantage of any special offers. Only one special offer per purchase, unless otherwise stated. Only one free gift is available per order, and will be delivered only while stocks last and if your choice of free gift is unavailable a substitute gift will be sent in its place. Danaefabienne Marketing de Cosmética S.L. will not be held liable if the free gift is not of the purchaser’s choosing. Free gifts cannot be exchanged for other products, nor can an equivalent monetary discount be applied to the order if the free gift isn’t wanted.
